I don't know if we can ever underestimate current canon Tony's ability to be an utter *dick*, but he's also capable of not being, still, so! Also if Falc actually got intercepted it would get complicated and plotty and possibly lead to 300,000 words and then threesome (after the inevitable resurrection), although admittedly it would not be the most auspicious beginning.
